(a) Consent Required: the consent standard depends on the nature of the communication. For transactional or deal-related texts, such as follow-up on active discussions, proposal updates, or contract-related communications, prior express consent is required, which may be provided verbally during a call or through prior email or phone engagement. For marketing or promotional texts, prior express written consent is required; written consent may be obtained through a web form submission or other written acknowledgment. Consent to receive SMS communications of any kind is not a condition of purchasing any product or service.
(b) Message Frequency: message frequency varies based on your engagement and communication preferences. You will not receive unsolicited bulk marketing texts.
(c) Opt-Out: you may opt out of SMS communications at any time by replying STOP to any text message. You will receive a single confirmation message and no further texts will be sent.
(d) Help: reply HELP to any text message for assistance, or contact us at info@cyberhillpartners.com.
(e) Carrier Disclaimer: message and data rates may apply. Cyberhill is not responsible for any charges applied by your mobile carrier.
(f) No Data Sharing with Carriers: we do not share your personal information with mobile carriers for their own marketing purposes.
(g) SMS Opt-In Data: your SMS/text messaging opt-in data and consent will not be shared with any third party for their own marketing or promotional purposes. This applies to all opt-in information collected through web forms, direct communications, or any other channel.
(h) No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5.) EMAIL COMMUNICATIONS AND CAN-SPAM COMPLIANCE


Cyberhill complies with the CAN-SPAM Act for all commercial email communications. In accordance with this law:


(a) We will not use false or misleading header information in any commercial email we send.
(b) We will clearly identify commercial email as advertising where required.
(c) We will include our physical mailing address in every commercial email.
(d) Every commercial email will include a clear and conspicuous opt-out mechanism. You may opt out by clicking the “unsubscribe” link in any email or by contacting us at info@cyberhillpartners.com.
(e) We will honor opt-out requests promptly. Once you opt out, we will process your request within ten (10) business days and will not send you further commercial emails.
Opting out of marketing or commercial email does not affect transactional or service-related communications necessary to fulfill an existing contractual obligation.

6.) THIRD-PARTY DISCLOSURE


We do not sell, trade, or transfer your personal contact information (name, email, phone number) to third parties for their own independent marketing purposes. We may share your information only in the following limited circumstances:

We will respond to verifiable California rights requests within 45 days, with a possible extension of an additional 45 days where reasonably necessary.

Texas Residents:


9.5 Texas Rights. Texas residents have additional rights under the Texas Data Privacy and Security Act (TDPSA), effective July 1, 2024:


(a) Right to Confirm and Access: You may request confirmation of whether we are processing your personal data and obtain a copy of that data in a portable, readily usable format.
(b) Right to Correct: You may request that we correct inaccuracies in your personal data, taking into account the nature of the data and the purposes for which it is processed.
(c) Right to Delete: You may request deletion of personal data you have provided to us or that we have otherwise obtained about you, subject to certain exceptions (e.g., legal retention obligations).
(d) Right to Opt-Out: You may opt out of the processing of your personal data for purposes of targeted advertising, the sale of your personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects. Cyberhill does not sell personal data and does not collect or sell sensitive or biometric personal data.
(e) Right to Non-Discrimination: We will not discriminate against you for exercising your TDPSA rights.
(f) Right to Appeal: If we decline to act on your request, you may appeal that decision by contacting us using the methods listed in Section 14. We will respond to appeals within 60 days. If your appeal is denied, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov.


9.6 Texas Response Time. We will respond to verified Texas rights requests within 45 days of receipt. Where reasonably necessary, we may extend this period by an additional 45 days, provided we notify you of the extension and the reason within the initial 45-day period. Responses are provided free of charge up to twice per year per consumer.

Virginia Residents


9.7 Virginia Rights. Virginia residents have additional rights under the Virginia Consumer Data Protection Act (VCDPA), effective January 1, 2023:

9.8 Virginia Response Time. We will respond to verified Virginia rights requests within 45 days of receipt. Where reasonably necessary, we may extend this period by an additional 45 days, provided we notify you of the extension and the reason within the initial 45-day period.


Other U.S. State Residents


9.9 Additional State Rights. Residents of certain other states (including Colorado, Connecticut, Utah, Oregon, Montana, Iowa, Indiana, Delaware, New Hampshire, New Jersey, Maryland, and Minnesota, among others) may have rights to access, correct, delete, and opt out of certain processing of their personal data under applicable state law. The general rights described in Section 9 above apply to all individuals to the extent permitted by applicable law.
